How H1B Visa FRAUD is killing America
The H1B visa was established by government to help American companies like Microsoft and others find workers they needed, when there were NO AMERICANS qualified to do the job.
From the beginning this was a fraud because this case is so rare it didn’t need any help from government. In fact American Universities have always produced more graduates than American business can hire and in all specialties.
This program was sold to congress based on the FACT there were NO qualified Americans to take the job. Big companies like Microsoft, IBM, HP, Intel, and others said they just couldn’t find enough engineers, programmers, project managers, program managers, database managers, network managers, etc in America.
Even during the high tech bubble this was NEVER TRUE!
I witnessed this FRAUD personally as workers in high tech companies were forced out and replaced by foreigners. American workers were required to train their foreign replacements. Yes they were given the following alternative: get fired this week or stay on for 90 days and train the INDIAN worker we hired to take your job.
A few said they wouldn’t train their own replacement, but most needed the additional 90 days work.
What is true is that Americans with these skills made a lot of money and this cost business a lot of money.
Bill Gates and the other rich and greedy don’t like paying high wages when they can pay low wages.
Today one in three (33%) of Microsoft workers are on contract.
So they LIED! They signed a statement that no qualified American candidates could be found. Each year the congress increased the number of H1B visas. The visa allows a FOREIGN worker to work in the US for 6 years, but ONLY for the sponsoring company.
Today there are 1,600,000 middle class jobs inside America being done by foreign workers. That is growing each year.
I can hear the right-wing Republicans and Tea Party screaming this is good for profits. Yes it is.
There are five basic reasons Microsoft, IBM, Apple and the others love the H1B program.
1. These workers work for a contract firm not Microsoft – THEY ARE NOT EMPLOYEES – but work only for one company
2. They work for 30% to 40% less than American workers
3. They work more hours for less pay – if they ever complain they are sent back to India
4. They must do whatever they are told or their contract will be cancelled and they will be sent back to poverty
5. They never make any demands on these companies for equal pay, good working conditions, 40 hour weeks, and they don’t report criminal violations of labor law
The saving are huge and they go directly to the CEO and the rich owners.
An American worker might cost $90,000 plus all the taxes included in employee wages and medical benefits (an additional 30%), while a foreign contractor would cost $60,000 flat with no additional costs to the company.
If you didn’t care about America and were only interested in increasing profits – you would do what Bill Gates and the others are doing.
With the foreign contractor you can demand they work 12 hours a day and come in on Saturday with no complaints. Not so with an American worker.
The new US business model is “CREATE NO NEW AMERICAN JOBS.” If you can’t send the job to India or China, bring an Indian to America to take the job.
This is why America will never get out of the downward economic trend we see today.
American corporations are committed to moving all middle-class jobs off-shore or giving them to H1B foreign workers.
Get your kids ready to work at Wal-Mart and the local mall for minimum wage. They will not be hired as “professionals” by America Companies.
No other western democracy allows this kind of program. Try this in Canada or Europe. It is NOT allowed – by LAW.
Do Bill Gates, Steve Jobs and the other billionaires really care about America? No they do not!
Independent sources have said the following about the H1B visa program:
1. Program is full of fraud – there are qualified American workers available for these jobs
2. These foreign workers depresses wages for the American workers
3. American workers are afraid of losing their jobs to this program
4. Foreign workers send tens of billions in US money back to their countries depriving the US economy of this spending – hurting all Americans
5. This creates more unemployment and costs everyone money
Why is this allowed and in fact being expanded even in this recession? Because business wants this program so the rich can get richer and the poor stay poor.
Both Republicans and Democrats are for this program. Elected officials from states with big company corporate offices like Apple, Microsoft, IBM and HP in their state, do what these big companies say so they can get reelected.
Let’s be clear who the villains are in this FRAUD. The foreign workers are NOT the villains. They are hard working people trying to make a living and improve themselves. It is the greedy uncaring CEOs who don’t care about America or American workers.
This doesn’t happen in any other western democracy – PERIOD!
Only in America would our government help American companies kill America jobs in the name of more profits for the rich. This is driven mostly by Republicans, who helped American companies eliminate 10 million American manufacturing jobs, moved to Communist China and are the major sponsors of the H1B program.

I agree with what you said about H1B might raise the competition finding a job between Americans and foreigners.
However, I suggest you not bringing the Christian faith / bible verses into this topic. What are you trying to say? Foreigners are not your neighbors? Based on national mind or international wide? Here it sounds like to me that foreigners are your enemies, I thought somewhere in the bible says "you shall love your enemy."

Why not help India improve it's own country by providing their own people with jobs in their own country rather than take away jobs in another country? That would help. but the major reasons for H1B is cost and control. The visa holder is a slave and not an employee with rights. They are also paid less and many times have no benefits or few benefits.

We need to take care first of American citizens. When American citizens go hungry and homeless, and people from other countries are employed and happy, there is a problem with this government. I agree with you.
It's not just the visa's. All of these tech companies have a presence off-shore with their own employed -- a significant part of their workforce is off-shore.
Our tech companies are increasingly hiring Indians, whether visas or not (usually not), because they are becoming a larger part of the work force and management, and are showing preference to their people; not hiring Americans, and hiring their people at a higher pay to boot. Somehow, they are seen as technologically savvy, and they just aren't as competent--and their degrees are meaningless.

It is unpatriotic and morally wrong to hire a foreigner over us citizen at any cost. As we can't replace our politician with best and bright politician from other country so should not we replace our workers. Only pimps are benefiting. US has has a lot of talent and the best universities. We need to thing our kids future

America should not put all its eggs in India's basket. They get trained here and compete agaist us. Most americans are in favor of Durbin/Grassley bill 887. Who would be against reducing fraud and abuse other than employers and contractors that depend on fraud and abuse?

Circuit City - Outsourced all IT to Indian-run IBM and went bankrupt shortly thereafter.
ComAir crew system run by 100% Indian IT workers caused the 12/25/05 U.S. airport shutdown when they used a short int instead of a long int
Computer Associates - Former CEO Sanjay Kumar, an Indian national, sentenced to 12 years in federal prison for accounting fraud.
Deloitte - 2010 - this Indian-packed consulting company is being sued under RICO fraud charges by Marin Country, California for a failed solution.
Dell - call center (closed in India)
Delta call centers (closed in India)
Duke University - Massive scientific fraud by Indian national Dr. Anil Potti discovered in 2012.
Fannie Mae - Hired large numbers of Indians, had to be bailed out. Indian logic bomb creator found guilty and sent to prison.

You look at Adobe Photoshop and all the names of the programers who worked on it are now indian. This is ridiculous. I live in Norther California in a town near silicon valley and my neighborhood and school are filled with Indian immigrants who all shun me as an American. They are not interested in being American but only with living amongst themselves. I feel like my town has been taken over by a foreign country and wish it was more diverse with all different people not just Indians. I KNOW there are or could be trained enough Americans for these jobs. This is just ridiculous.

I completely agree with the above comment even though i am an Indian.Most of the Americans might be thinking why is india still poor when most of their job goes to India.Let me tell u the capitalist system in India is far more mean and corrupt(corrupt to the core)than the American ones.Over there everyone is exploited in the name of performance and brains.Politicians just give a reason that migrants perform better than usual Americans.Over here people are exploited in the name of religion and caste.Unlike US India does not have fair regulated labour laws,infact the whole labour and education system is based on reservations given to different castes regardless of their capabilities and degrees(a comment posted clearly mentions that they are "meaningless degrees").Whatever little achievement India has made is all because of the efforts of middle class,otherwise there is no hope that India can actually be on the path of prosperity.

Thousands of direct jobs are created in USA
by NRI indians..who manage successful companies.
Inaddition to thousands more indirectly.
2) The software consulting firms like
TCS,infosys,Wipro,Tech mahindra,etc
These firms had benefitted from outsourcing
but the indian employees were cheaply paid.
Now in the past few years, they are hiring thousands
of US Engineers/employees of american origin.
3) Direct investment(billions $$$) by Indian firms like
Reliance (into Hollywood) Dreamworks ,
Reliance into US OIL shale blocks
TATA group acquiring Jaguar/Land rover dealor ships
worldwide( USA,UK,China,India..etc..)
d) for the final part, abt Sundaresh (Adaptec)

awards and created 5 new products (SCSI) in
their ASIC engg team. The CEO when i worked

As of the article I guess the comment by "jewfromoregon" is self expressive and relevant.I have lived in USA for 5 years since i was completing my M.Tech and Phd.While staying there i found out that the American High School students are least interested in studies for them Gossip,partying and Dating takes the first priority.A school in Cleveland had 80% failure rate in 2008 and to my surprise many of them were in grade 10th for 4 years,if this was the case in India or China the student would have been kicked out of the school,disowned by society and ultimately the student would end up with a suicide.There is no problem with Education System of US the only problem is with their students and their attitude towards studies,those students can tell you the recent happenings in Angelina Jolie's life but can't tell the capital of Kentucky.The US govt. needs to seriously think about it.
If you ask me, Bill Gates should be put behind bars in a Federal prison for crimes against America. I hope he moves to China since he likes China so much. Most every single Microsoft corporate building that's all you see is H1b & L1 Visa workers coming and going. And it's also quite true...our own skilled American engeineers are being kicked out in favor of these forerign workers.
So, whenever you see old Bill Gates up in front of Congress, he only there to cry and moan how he needs higher and higher quotas of these workers.
This is ridiculous. There are more Indian employees in my job place than Americans. They hold each others back while discriminating against other nationalities even Americans. I am not sure what Americans can do. But I think this problem should be solved otherwise it gets out of hand. They come here with no money and within a few years they got good jobs in fortune 500 companies and they got expensive houses and cars. They bring all their relatives here and put them on food stamp and medicade/medicare and collect all the money that should go to American families. It is so sad. Somebody should do something about it. Any Suggestion what we can do about this. How to stop the American jobs go to China and stop bringing Indian here and giving them American jobs? I think this should go to facebook as well.
If we look at the other side of american corporates, everybody in the world drink Pepsi/Code today.. in india, billions of people drink Pepsi/Coke to give revenue of miliions of dollors every month.. America can put shops and sell its products in other countries, but it will not allow foriegn labors.. then what is "globalization"?..
McDonalds/KFC/Levis/Ford/MS etc etc have put their shops everywhere in the world to already wipe out the local companies..

Well 1st of all US is a capitalistic economy where demand and supply (free market forces )determine the need for resources. The protectionist people should have shifted to russia/cuba/china or any other socialist country. Do remember these very people were proud of their capitalistic routes before 2000. Again I am not against any protectionist measure which would help people gain employment and bring US out of this rubble but people are shouting about the smoke rather than the fire...and focussing on the symptom..I will like to say how..
People talk about h1s maybe initially they brought in many people to cut costs but in the current scenario the pay difference does not really make a lot of sense.Just fathom this..a guy on h1b from india getting 60k does get similar benefits. Factor in the costs for H1,lawyer,travel it would reach around 70. Add the risk factor due to cultural differences and language along with visa rejections and other risks you wont really find immense amount of benefit to the employer to get a foreign worker. Then why so many H1bs....The fact of the matter is company dont invest enough in training or spend in ramp up time. Most experienced people in US were wizards of the 80-90s technology such as mainframes etc but with the advent of newer technologies people from east have had the chance to work first.Training people in india is also cheap and easy. So that makes a major difference in costs.

1.American graduates unlike Indian graduates do not have to go through any tough tests for jobs.Those tests are designed to "burn your nerves" literally.And they are the only way of getting job which is the only reason why your office is full of them.
2.Some MNC's even consider the high school grades scored by the students.For Indians and Chinese(Asians to be precise) Education always takes the first priority and High Schools are there deciding years.These kids burn their asses on for studying and getting first division grades whereas their american counterparts are busy getting low partying,Dating and losing their virginity(All those things are considered sin for a high school students in India and china)
American students should also do the same as their Asian counterparts to get their jobs back otherwise there would be a day when these Companies would have sucked out all the resources from America and would Head towards India and China.Now is the time for u guys to act and consider the above suggestions rather than criticizing to these deaf eared capitalists,otherwise get ready to suffer your fate.
As of Indians bringing all their relatives to America and putting them on food stamps or medicare is a thing of fantasy.Just look at the statistics on those people relying on Fedral Aid program(Indians relying on it are virtually non-existent in that) and then comment.I know u have a grudge against Indians but putting such facts won't make it any better.

It's funny you should say '..when american talent is available' .. Really? I went to three US schools. In all schools I went to, the best guys in the class were invariably Indians or Chinese. There were only very few American students in the class (who were just average) . I repeat the comment just above - Yes Indians and Chinese students work their ass off in school while Americans party.
